Introduction and Acceptance of Terms

These Terms of Service ("Terms"), which include and incorporate our Privacy Policy (set out in the sections below), are a legal agreement between you and Foxy and its creator ("WinG4merBR", "we", "us", or "our"). By using Foxy (the "Bot"), the website located at https://foxybot.xyz, or any related services (collectively, the "Service"), you agree that: (i) you are at least 13 years of age, or the minimum age required to use Discord in your country, whichever is higher; (ii) if you have reached the age of legal majority in your jurisdiction, you have read, understood, and agree to be bound by these Terms; and (iii) if you are between 13 and the age of majority in your jurisdiction, your parent or legal guardian has reviewed and agrees to these Terms on your behalf. If you do not agree to these Terms, you must not use the Service. This document applies to Foxy ("FoxyBot", "Foxy Discord Bot", "FoxyDBot", "bot", "our bot"). By using our bots, you agree to be bound by this agreement. We may change, add, or remove portions of these Terms at any time, at our discretion, and you agree to be bound by such modifications. We will make reasonable efforts to notify you of material changes, such as by posting them on the Service or announcing them on our official support server. Any changes become effective five (5) days after being posted on the Service, and your continued use of the Service after the effective date constitutes your acceptance of those changes.

Service Usage Rights

The Service provides an extension and companion to the Discord platform. Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license for personal, non-commercial use. You agree not to use the Service for unauthorized purposes, not to copy, resell, or distribute it, and to comply with the Discord Terms of Service and Community Guidelines. We may modify, suspend, or terminate your access to the Service at any time, with or without notice, as described in the "Termination and Suspension" section.

Fees

Basic functionality is free, but some features, subscriptions, or Virtual Goods may require payment. Prices are displayed in the Bot or on the website and are handled by third-party payment providers. You are responsible for any applicable taxes. Payments are processed by third-party providers and are subject to their own terms. Refunds are handled as described in the "Refund Policy" section below.

Refund Policy

Before requesting a refund, or opening a chargeback or payment dispute, you must first contact us by opening a ticket in our official Discord support server and give us a reasonable opportunity to resolve the issue. Many problems can be resolved quickly, without the need for a refund.

Refund requests are evaluated on a case-by-case basis, subject to the terms of the third-party payment provider that processed your purchase. Where a refund is granted, any Virtual Currency or Virtual Goods obtained through the refunded purchase may be removed from your account.

If you request a refund and the corresponding amount is returned to you, we reserve the right to permanently suspend you from using Foxy and any of its services. Opening a chargeback or payment dispute without first contacting our support team may likewise result in the permanent suspension of your access.

Your Content

Any data, text, images, or other materials uploaded, submitted, or made available by you through the Service are "Your Content". You represent and warrant that you own or have all necessary rights and permissions to Your Content, and that it does not infringe the rights of any third party or violate any law. By uploading Your Content, you grant us a perpetual, royalty-free, worldwide, non-exclusive license to use, reproduce, modify, distribute, and display it solely to operate, provide, and improve the Service. We are not responsible for user-generated content and may remove or refuse to display any of Your Content at any time, including content that violates these Terms or applicable law.

Stored Content

• Executed Commands: stored for usage metrics and security.
• Your User ID: used to create your Foxy profile.
• Your Server ID: stored to provide moderation commands.
• Server Settings and Configuration: stored so your modules and preferences are preserved (see "Deletion of Your Information").

Content We Access but Do Not Store

• Roles and Channels: required for auto-mod features, customizable by you.
• Message Content: accessed but never stored; only used when necessary.

Cookies

We use cookies and similar technologies to keep you logged in so you can access the Foxy dashboard and to remember your preferences, such as your selected theme.

Virtual Currency and Virtual Goods

The Service may provide Virtual Currency (such as Cakes) or Virtual Goods. Purchases are non-transferable and may not be sold, traded, or exchanged for real money or anything of real-world value. Unauthorized trading is prohibited and may lead to the permanent termination of your account. Refunds for Virtual Currency and Virtual Goods are handled in accordance with the "Refund Policy" section. We reserve the right to modify, revoke, or remove Virtual Currency and Virtual Goods at any time.

Data Administration

We process personal data in accordance with applicable data protection laws, including the Brazilian General Data Protection Law (LGPD) and, where applicable, the General Data Protection Regulation (GDPR).

Personal data may be accessed only by Vitor (WinG4merBR – 687867247116812378), who agrees not to share, sell, or distribute data, except to Discord or competent authorities when required by law or necessary to protect the safety, rights, or property of Foxy, its users, or the public.

We apply reasonable technical and organizational measures to protect your data. If a security incident affects your personal data and may cause you significant risk, we will notify the affected users and the competent authority as required by law.

Subject to applicable law, you have the right to access, correct, update, or delete your personal data, to request information about how we process it, and to object to or restrict certain processing. To exercise these rights, contact us through our official Discord support server.

Deletion of Your Information

You can delete your Foxy account at any time through the website by selecting "Delete Account". This removes the personal data associated with your account, except where we are required to retain it by law or for legitimate purposes such as fraud prevention and security.

When Foxy is removed from a server, that server's settings and configuration are kept for up to 14 days. This lets you re-add Foxy within that period and keep everything configured, without having to set it all up again. After 14 days, the server data is permanently deleted. You can request immediate deletion at any time by opening a ticket in our official Discord support server.

Intellectual Property Rights

The name "Foxy" may be used publicly, but the Service's images, logos, and artwork are owned by the Service and require permission from WinG4merBR for use, with proper credit. The code is licensed under the AGPL-3.0 license; modifications must remain public and credit must be given. All rights not expressly granted to you are reserved.

Termination and Suspension

We may suspend, restrict, or permanently terminate your access to the Service at any time, with or without notice, if you violate these Terms, the Discord Terms of Service, or applicable law, or if your use poses a risk to the Service or to other users. Conduct that may result in permanent suspension includes, without limitation: fraud or abuse of payments, chargebacks or refund disputes opened without first contacting our support team, attempting to evade a ban, exploiting bugs or vulnerabilities, and any conduct described in our Community Guidelines. If your access is terminated, the license granted to you under these Terms ends immediately. Sections that by their nature should survive termination — including "Your Content", "Intellectual Property Rights", "Disclaimer of Warranty", "Limitation of Liability", "Indemnification", and "Governing Law and Jurisdiction" — will continue to apply.

Disclaimer of Warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED, OR THAT ANY DEFECTS WILL BE CORRECTED.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. TO THE SAME EXTENT, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO US IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD 100. NOTHING IN THESE TERMS EXCLUDES OR LIMITS ANY LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW, INCLUDING LIABILITY FOR WILLFUL MISCONDUCT OR GROSS NEGLIGENCE.

Indemnification

To the maximum extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Foxy, its creator, and their partners, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (i) your access to or use of the Service; (ii) Your Content; or (iii) your violation of these Terms or applicable law.

Governing Law and Jurisdiction

These Terms are governed by the laws of the Federative Republic of Brazil, without regard to its conflict-of-law rules. Subject to any mandatory consumer protection rules that apply in your jurisdiction, you and we agree to submit any dispute arising out of or relating to these Terms or the Service to the competent courts of Brazil. Nothing in this section prevents you from exercising any rights you may have under the mandatory laws of your country of residence.

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
